Please read these Terms of Service ("Terms") carefully before using tsurt.com (the "Service"), operated by TSURT, LLC ("TSURT," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. ELIGIBILITY / ACCOUNTS

You must be at least 18 years old to create an account or make a purchase. When you create an account, you agree to provide accurate, complete, and current information and to keep it updated. You are responsible for safeguarding your account credentials and for all activity under your account, and you must notify us immediately of any unauthorized use. We may refuse service, terminate accounts, remove content, or cancel orders at our sole discretion.

2. PURCHASES; PRICING; ORDER ACCEPTANCE

When you make a purchase, you may be asked to provide payment and shipping information and you represent that you are authorized to use the payment method. We use third-party payment processors to complete transactions. We reserve the right to refuse or cancel any order, including where we suspect fraud or an unauthorized or illegal transaction, or where there is an error in price or product description.
We strive for accuracy, but the Service may contain errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability, and we reserve the right to correct them and to change or update information at any time without prior notice. Prices are in US dollars unless stated otherwise.

3. SHIPPING, RETURNS & REFUNDS

Shipping, delivery timing, international duties/taxes, and shipping restrictions are governed by our Shipping Policy. Returns and refunds are governed by our Return & Refund Policy. Both are incorporated into these Terms by reference. EU customers may also use our EU Withdrawal Request form linked in the Site footer.

4. PROMOTIONS

Any contests, sweepstakes, or promotions made available through the Service may be governed by separate rules. If those rules conflict with these Terms, the promotion rules control.

5. MOBILE / SMS MESSAGING TERMS

The TSURT mobile message service (the "Messaging Service") is operated by TSURT. By providing your mobile number and opting in, you agree to these Mobile Terms.
- By consenting, you agree to receive recurring automated marketing and informational text messages (e.g., cart reminders, offers, order and account alerts) from or on behalf of TSURT at the number provided, even if it is on a Do Not Call list. Consent is not a condition of any purchase.
- Message frequency varies. Message and data rates may apply. You are responsible for charges from your wireless carrier.
- To opt out, text STOP at any time; you will receive a one-time confirmation. For help, text HELP or email support@tsurt.com.
- Carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number and to notify us if your number changes.
- We may change or discontinue the Messaging Service or any short code/number with notice as required. Your use is also governed by our Privacy Policy.

6. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are and will remain the exclusive property of TSURT, LLC and its licensors. TSURT sells officially licensed merchandise for various artists and brands; all artist names, logos, artwork, and trademarks/trade dress are the property of their respective owners and are used under license or with permission. None of these marks may be used without the prior written consent of the applicable rights holder.

7. COPYRIGHT / DMCA POLICY

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). To submit a notice, email support@tsurt.com with the subject "Copyright Infringement" and include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL or location of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act. Misrepresentations may result in liability. Our designated Copyright Agent can be reached at support@tsurt.com.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event will TSURT, LLC or its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be waived under applicable law.

13. GOVERNING LAW

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Our failure to enforce any provision is not a waiver. If any provision is held invalid, the remaining provisions remain in effect.

14. CHANGES

We may modify these Terms at any time. If a change is material, we will provide at least 30 days' notice prior to the new terms taking effect. By continuing to use the Service after changes become effective, you agree to the revised Terms.
